Whitsunday Rent A Yacht

The Operator joined with Australian Bareboat Charters several years ago to become the largest Australian owned yacht rental company in Australia. Collectively they have organised boat rentals for fun family boating holidays, group sailing yacht and motor cruiser adventures and romantic getaways for over 40 years.

Our New Premises
Due to the company growth, clients are now prepared for yacht charter packages and boat charters for sailing yachts and motor cruisers but in the brand new premises, the largest and most modern of its type in Australia for sailing holidays.

Suggested Itinerary:
- Day 1. Arrive at base, where you will be prepared for charter with an approx. 3 hour briefing. This consists of an area briefing, followed by a “hands on” boat familiarisation. Before your briefing, you may load your personal gear on board. If we have organised your food and beverages, this will already be stowed for you. Your personal cruise guide will take you for a sail or drive, of your boat, to ensure you and your group are confident in its handling. You may then head off to your first overnight anchorage such as Long Island, which is approximately a one-hour sail from our base, and let your Whitsundays holiday activities begin. There you have a choice of anchorages off the island resorts of Club Crocodile or Peppers Palm Bay.

- Day 2. Next morning the real Whitsundays activities begin - take your dinghy ashore and go for a bush walk through the lush rain forest, which will be throbbing with bird song. Then be enticed back on board by the aroma of breakfast. All vessels are supplied with barbecues mounted on the stern - essential for one of the ultimate Whitsundays holiday activities, a cooked barbecue breakfast.

At 8am you will be contacted on your first scheduled radio call. These are conducted every morning and provide you with a weather forecast and we record your plans for the day. Note we also conduct a 4pm “sched” to ensure you are safely tucked in for the night.

After the “scheds”, set off on a leisurely sail or cruise to the east in the direction of Whithaven Beach. You will pass Gulnare Inlet and the craggy shores at the bottom of Whitsunday Island. The largest in the group, Whitsunday Island is uninhabited and blanketed in lush green vegetation dotted with majestic Hoop pines. You will notice Whitsunday Peak, which reaches 1296ft above sea level and is a great landmark for navigation as it can be seen from virtually all directions. As you cruise through the narrow Fitzallen Pass, you will also skim the northern face of Hamilton Island and Hamilton Island Resort which is the biggest resort in the area and offers a variety of restaurants and great facilities to the visiting yachtie..

One of the next Whitsundays activities is the trip from Long Island which will take approx. 2 hours to reach Solway Pass. As you enter the pass you will see your first dazzling glimpse of Australia’s most famous beach, Whitehaven Beach, with its 6 kilometres of pure white silica sand and clear turquoise seas. The best anchorage is off the rocky point at the south end of the bay.

Whilst your there travel by dinghy or walk to the northern most point of the beach and to the lookout on Tongue Point, for one of the best views in imaginable.

When visiting Whitehaven there is also an overnight anchorage to the north, called Apostle Bay. Alternatively travel east to Hazelwood Island and anchor at Chalkies Beach on the western face. Windy Bay on the north and White Bay on the south offer magnificent expanses of coral reef.

Day 3. Out of bed early to cast your line or have an early dip as the sun over the sparkling seas, then enjoy a leisurely breakfast on the beach. After speaking with our base at 8 am head up the spectacular east coast, past the amazing Hill Inlet with it’s pure white sandy shoals and beaches. Here too you may see mantaray, dolphin and huge green turtles bobbing in the clear blue water.

Pick up a mooring at Border Island and relish a barbecued fish lunch on board before walking to the top of this grassy little island which offers a 360-degree view of the area. The island appears surreal with its low shrubs and grass trees “standing guard” amongst the bushy thicket. Exotic bush orchids, with their meter long flower spikes, cling to the rocky outcrops. The snorkelling is very good too, as the bay to the north is protected and has excellent coral reefs. This is an overnight anchorage and a lovely, secluded stopover worth visiting.

Or you may prefer to cruise through the narrows of Hook Passage, to the south of Hook Island to Macona or Nara Inlet. Note Hook Island Resort has changed hands and is currently being rebuilt.

- Day 4. Nara Inlet is deep and fiord like with steep heavily wooded embankments. If there’s been recent showers, small waterfalls tumble down the rocky faces to shore and provide a refreshing bath, particularly if you’ve just tackled the exhilarating climb to explore the caves, with ancestral aboriginal rock paintings, located in the area.

- Day 5. A short cruise around to the western face of Hook Island (the second largest in the group) then head north to Langford Reef. This is a delightful day time stopover with the reef and sand spit emerging at low tide and then disappearing at high tide. It’s a great area for picnicking at low tide. The vast array of cheeky fish seething amongst the coral “bommies” makes it one of the best snorkelling spots in the area. As navigation can be tricky through the reefs always refer to your chart and the “100 Magic Miles Guide” which shows how to enter the area safely.

- Day 6. Head south to Cid Harbour, spot the majestic sea eagles that scoop the waves for small fish. The main anchorage at Sawmill Beach, is off a shoaling sandy beach edged with reef. If you’re feeling adventurous, climb through the rainforest over spring fed streams and palm forests to the top of the Whitsunday Peak. For the less energetic, the bush walk to Dugong Inlet, which offers a beautiful secluded beach, is well worthwhile. Expect to encounter large, lazy goannas and lots of bird life on the way.

- Day 7.
Approximately one hour sail to the west will take you to South Molle Island Resort. A fun relaxed resort, check with our base to check out their entertain programs. You may also use the facilities such as shops, showers, bare, laundry etc.

- Day 8. Slowly cruise to our homeport, past the colourful Daydream Island Resort and Spa, one of the more recently refurbished resorts in the area. We also offer a 7-night package which combines 5 nights boating adventure followed by 2 nights of pampering at the resort.

Note : When booking an 8 or more night charter you are required to return to base for a mid charter turnaround, to top up water and fuel, fresh linen and fresh food and drink plus anything else the you and your group may require. If you would prefer to spend a few extra hours, you can catch a bus or taxi to Airlie Beach and Cannonvale to explore this beautiful little mainland resort. It offers a very good variety of shops and restaurants plus medical etc. facilities. Charterers can return to base, collect their vessel and then continue to their next overnight spot. However they may choose to have a night out at Airlie Beach, stay overnight on their yacht at and head off the next morning. Or sail to Airlie Beach and anchor off the main beach opposite the sailing club. Another option is to proceed to the Abel Point Marina at Cannonvale..

- Day 9. Sail to Hamilton Island resort for a visit and a little retail therapy or simply relax and enjoy the bustling boatie atmosphere in the harbour village. An overnight stopover is permitted and is generally in a marina berth and a fee applies. The island also has a major airport. Consider a trip to the outer barrier reef by helicopter during your stay. Sightseeing Seaplanes can also be organised to collect you from your boat in selected anchorages.

- Day 10. Cruise to Club Med Lindeman Island. The only Club Med resort in Australia. If you wish to visit the resort you must pay for a pre costed meal package. There are several anchorage options in delightful bays on or near the island.

- Day 11. Visit uninhabited Shaw island which offers several great anchorages. Explore Neck Bay on the western face. The short walk through palm groves takes you to the eastern face of the island. Cruise to the southwest to anchor off Burning Point, an ideal anchorage when there’s a brisk “sou’easter” blowing or around the southern tip to Billbob or Ruberta Bays. Shaw Island is rugged, spectacular and possibly one of the most beautiful in the area. If time permits, we suggest several nights should be spent in this area. However check your vessel cruising limits before venturing south of Shaw Island.

Some vessels can go as further south to Thomas Island. As this is a more remote area, other bareboating vessels are rarely seen this far south.

There are 74 islands in the Whitsunday area. 6 islands have resorts on them, nine in total. Most of the resort islands are basically uninhabited except for the area allocated to the resort buildings and facilities. Charter yachts are welcome to visit them and a fee generally applies costing between AU$30 and AU$80 per vessel per night. The facilities vary with each island. When paying these fees you are entitled to use the facilities such as toilets and showers, laundry, swimming pools etc. and to purchase goods such as meals, beverages, ship supplies, and souvenirs.

There are approximately 120 approved overnight anchorages in the area. The suitability of each anchorage depends on the weather forecast.

Note: although charterers may book a minimum 5 nights to 14 night (or longer) they may prefer to visit only 6 or 7 anchorages and stay several nights in a favourite spot. Each anchorage has its own individual charm and no two are the same!

Whitsundays Activities:
The Whitsunday Islands are world known for having global standards in resort accomodation. Hamilton Island, Hayman Island, South Molle, Daydream Island just to name a few are continually setting the pace in island resorts and island accommodation for overseas competition in terms of Island Resort facilities, service and fun.

Why not sail to them all on your own luxury yacht? You can choose to anchor off shore and stay in the cabin of your luxury yacht or perhaps stay overnight in the Magnificent Hamilton Island Marina. Either way there is truly no better way to explore and party the Whitsunday islands Resorts and other island accommodation than in your own luxury yacht.

Of the 74 islands in the Whitsundays group, only 8 are inhabited. That leaves 66 opportunities for a Whitsundays Island escape where you can explore by luxury yacht or camp out in spectacular style. Sail a chartered luxury yacht and drop anchor in an isolated inlet of a deserted Whitsundays Island and stay there for as long as your provisions last. Alternatively, take a boat or plane ride to the island of your choice. These Whitsunday islands are out of the blue. The discovery can be yours!

Hamilton Island
: Hamilton Island is situated in the heart of the Whitsundays, a group of 74 tropical islands, only 12 of which are inhabited, situated in the Coral Sea between the Queensland coast and The Great Barrier Reef. Hamilton Island is the largest inhabited island in the Whitsundays and is the only island with an airport catering for direct commercial and charter flights. The island is serviced by approximately 40 flights a week by Virgin Blue and Jetstar including direct flights from Brisbane, Melbourne, Sydney and Cairns with convenient connections to domestic and international ports. It is approximately a two-hour flight from Sydney, just over one hour from Brisbane.

Hamilton Island is a complete, year-round holiday island destination offering an extensive range of activities ensuring there is something for everyone, whether they be families with young children, the young at heart, adventurous travellers looking for exciting activities, mariners, business travellers, romantics or honeymooners. There are over 20 klms of bushwalking tracks on Long Island offering some of the prettiest hiking in The Whitsunday Islands.

South Molle Island: Nearby South Molle Island has been a Mecca for family groups for years. Consisting of 405 hectare of unspoilt national park rimmed by scenic beaches, bays and inlets. Explore 16 klm of walking track that take you through lush forests to hilltop lookouts offering panoramic water views of the Whitsunday Islands. Known as the " happy " resort, its many facilities including 9 hole golf course and all-inclusive rate make it a very attractive Island holiday destination.

Lindeman Island: For an all-inclusive island holiday where the emphasis is on fun in the sun, head to Lindeman Island for Australia's only Club Med resort accommodations. There are enough activities and water sports on this National Park Island to keep you going all day long and everything from a round of golf to international cuisine and mealtime drinks included.

Nara:
Nara is a narrow 3kl inlet, very protected and suitable as an overnight anchorage in all weather conditions. Here too the fishing is great and there are lots of oysters to gather from the rocky shores at low tide.

The inlet offers several anchorages however we recommend the one at the top as it is the most protected and quite beautiful. This anchorage is surrounded on 3 sides by steep rocky faces with ferns, palms and variety of other rainforest plants and is near the main waterfall.

Cid Harbour: Cid Harbour, one of the most popular anchorages in the area is situated on the western face of Whitsunday Island. It is often chosen as a “first night” anchorage as it is approx. a 2-hour sail Shute Harbour.


Whitsunday Rent A Yacht Terms & Conditions

Important information about your voyage
Prior to departure you will be required to sign a rental agreement with the Operator of this vessel. Here is a summary of the terms and conditions:

Interpretation
The Operator includes the owner of the Boat, the Operator's subsidiaries, employees, directors, affiliates, agents and subcontractors appointed by the Operator. The Charterer includes the Charterer's guests, family, employees, agents and crew members. In this agreement, unless the context otherwise requires, the singular includes the plural and vice versa, words denoting gender shall include all other gender, headings are for convenience of reference only and shall not affect construction of the agreement. Children are defined as persons under the age of sixteen years. Time is of the essence of this agreement.

Deliver
The Operator shall deliver the Boat at the Port of Delivery staunch, clean and in full commission ready for service at Midday. The Operator may allow credit pro rata for charter fees covering periods of delay in delivery. The Operator has the right, at its discretion, to substitute a boat of similar type or to cancel the charter and to refund the charter fee. If the Operator fails to make delivery within twenty-four hours after the due time then the Charterer may cancel the agreement and a full refund of the charter fee will be paid.

The Operator shall then have no further liability to the Charterer beyond that refund. The Charterer warrants that he will examine the Boat before taking delivery and by accepting the Boat shall be deemed to have satisfied himself that the Boat is staunch and property outfitted for a yacht or motor cruiser of her type, size and accommodation. Should the Charterer not be ready to accept delivery of the Boat at the stated time for delivery for any reason the Operator has the right to set the time of delivery any time within the next twenty-tour hour period. In that event there shall be no partial refund for any of the charter time lost. The charter period commences with the compulsory area briefing and boat familiarisation or sail orientation.

YACHT CHARTER BOOKING INFORMATION

Yacht Charter Booking Deposit
A deposit is required when the booking is confirmed.

Charter Balance Payment
The balance of the charter fee at least 65 days prior to commencement of the charter period, late payment will incur a fee of $250.

Cancellations
If a cancellation is made outside 65 days of your departure date for the sailboat charter, booking fees received will be refunded less a $200 cancellation of sailboat charter fee. For cancellations made within 63 days of your boating charter departure date, the full charter fee shall remain due and payable and will not be waived or refunded unless the Operator is able to obtain an alternative booking for the same charter period and at the same rate. If a lesser rate or a lesser period then there shall be only a pro rata refund. All cancellations of the sailboat charter booking must be in writing.

Travel and Cancellation Insurance
The Operator strongly recommends that you take out adequate insurance for boat rental on your sailboat charter to cover yourselves in case you are forced to cancel due to unforseen circumstances, curtailments or interruptions beyond your control. A visitors plan is available for overseas clients.

Bareboat Hirers Liability Insurance: This policy is designed to protect you from claims made against you by others for Property Loss, Accidental Death, Bodily Injury or Illness to them caused by (or as a result of) your negligence. For this policy to apply to you, the hired vessel or the tender must be involved in the loss.

Marine Park Fee
The Great Barrier Reef Marine Park Fee (plus associated charges) is applicable to all charters, payable in full prior to departure. Departures from 1st April 2010 Environmental Management Charge of $5.50 per person x 3 nights ($16.50) plus administration charge $8.50 – Total per person $25.00.

Damage Levy Fee
Is non refundable and provides the charterer with a No Blame Policy that protects the charterer against any cost incurred to rectify damage to the vessel and its fittings or loss of inventory from the vessel, providing at all times the charter vessel is operated in a safe and responsible manner in accordance with the charter agreement. The fee is calculated at a rate according to vessel size by the number of nights of the charter.

Cost Damage Levy Fee
30ft to 34ft -  $45 per boat per night
35ft to 38ft -  $58 per boat per night
39ft to 50ft -  $65 per boat per night
8 - 10 nights pay 7 nights.  11 nights pay 8 nights. 12 nights pay 9 nights.  13 nights pay 10 nights. 14 nights pay 11 nights.

Bond Option: Non refundable Damage Levy Fee $100 plus refundable $2500 Bond option is available.

The operator reserves the right (without showing cause ) to apply the Bond option.

Inventory
At the time of delivery the Charterer shall, if requested by the Operator, complete, check and sign a record of inventory and on redelivery to attend to checking with the Operator and to countersign the record of inventory after checking. Any lost or damaged inventory item shall have all expenses relating to the loss or damage debited against the security bond if applicable.

Running Expenses

The Charterer shall pay all running expenses during charter period including pilotage, port charges, cruise guide and crew charges, service calls if applicable , refuelling costs, and provisions and supplies for him and his party. The charterer is required to provide credit card details and authorisation for payment to cover any outstanding fees and charges.

Competency
In this clause "competent person" means a person competent in the handling of the type of boat chartered including:

  • Knowledge and practical experience of seamanship; and
  • Knowledge and practical experience in the handling of inboard auxiliary powered sailing craft and associated equipment of the general type and size of boat.
  • The Charterer warrants that he is a competent person in the handling and operations of the type of boat chartered.
  • The Charterer undertakes not to permit any other person to operate the Boat unless that person is a competent person.
  • Fluent English - being able to speak and understand communications in the English language.

The Operator reserves the right to require the Charterer and any other person who shall operate the Boat to demonstrate to the Operator that they are competent persons. Should the Operator not be satisfied with the competency of the Charterer, the Operator may require a cruise guide on board the Boat for such period as determined by the Operator.

In the event that the Charterer or any other person is considered by the Operator to be an incompetent person as a result of any misleading, deceptive conduct or misrepresentation by the Charterer and upon which the Operator has relied to form an opinion then the Operator shall have the right to install a competent cruising guide aboard the Boat and at its election to terminate this agreement. The Operator shall have the right to recover all losses against the Charterer without any liability to refund or compensate the Charterer.

Navigation and Other Limits
The Charterer shall restrict the cruising of the Boat from 0800 to 1600 hours unless authorised by the Operator. The Charterer shall limit his cruising perimeter to the area and limitations clearly defined and specified by the Operator. The Boat shall be employed exclusively as a pleasure boat for the sole and proper use of members of the Charterer's party. The Charterer shall not carry on the Boat more than the specified number in the party and the Charterer shall not permit any other party, except competent persons within the Charterer's party, to operate the Boat unless the prior written permission of the Operator is obtained.

The Charterer shall not race the Boat. The Charterer shall not raft up the Boat up against any other vessel. Except with authorisation of the Operator the Boat must not be used for towing. There must be no transferring of any equipment from the Boat. The Charterer shall not engage in trade including transporting merchandise or passengers for pay. No goods, documents or drugs shall be carried which would involve the risk of seizure of the Boat by any government.

Pets shall not be taken on the Boat. Children must be under the control or a responsible adult. That adult is responsible for the conduct and personal safety of the children while on the Boat. The Charterer shall not allow any person on board to commit any act contrary to the laws of Australia, or of any other government within the jurisdiction of which the Boat may be at any time and shall comply with the law in all other respects. The Charterer shall not tie the Boat up at any jetties or piers except those approved by the Operator prior to the charter or make any landing with the Boat.

Charterer's Authority
At the commencement of the charter period the Operator shall relinquish its possession and command of the Boat to the Charterer and full authority regarding the management of the Boat and its crew or members of the charter party shall be transferred to the Charterer for the period of this charter. Should a cruising guide be put on board either at the Charterer's request or at the Operator's option the cruising guide shall be the sole responsibility of the Charterer and the Charterer shall pay the Operator for the cruising guide at the current daily rate listed at the Operator's offices and feed and accommodate the cruising guide. If a cruising guide is put on the Boat, then although the Charterer shall have possession, command, navigation and full control over the Boat, the cruising guide is to be sole judge as to whether it is reasonable or prudent to travel at any time and as to whether any specified anchorage is reasonably safe.

Redelivery
The Charterer shall redeliver the Boat to the Operator free from any indebtedness which may have occurred on the Charterer¡¦s account at the Port of Return together with all of its equipment, in the same good condition as it was at delivery, save for fair wear and tear from ordinary and proper use. If for any reason other than that the Boat has become a total loss, he shall fail to redeliver the Boat at the agreed place and time, he shall pay the Operator demurrage at the rate of the charter fee per night of the Boat plus 50% for every day or part of a day ("Agreed Demurrage") until redelivery is effected. If the Charterer leaves the Boat at any place other than the Port of Return he shall pay to the Operator, all expenses involved in transferring the Boat to the Port of Return: Agreed Demurrage for the number of days required for the transfer; plus any losses or damage not covered by the Operator's insurance which may occur on or to the Boat or otherwise arises from the redelivery until it has been redelivered to the Charterer at the Port of Return. In the event the Charterer should elect for any reason to redeliver the Boat prior to the end of the charter period the Operator shall not be liable to return any part of the charter fees.

Cleaning
If upon completion of the charter the Charterer has not left the Boat in clean and tidy condition then the Charterer shall pay for the costs of cleaning the Boat.

Service Calls
In the event of a malfunction of the Boat or its equipment, the Operator shall subject to prevailing weather conditions use its best endeavours to reach the Boat with a service call at the earliest opportunity. In the event a service call is not in the Operator¡¦s opinion reasonably possible, or if the problem cannot be otherwise rectified, the Charterer shall proceed to the point designated by the Operator where repairs or replacement, where possible, will be made.

Recall
Operator reserves the right to recall the Boat at any time if the weather is considered by the Operator to be a threat to safe operation or in the Operator's opinion the Boat is being improperly or incorrectly sailed, managed or controlled so as to imperil the Boat, other vessels or property or life. A recall may include but is not limited to a recall to the Operator's base or an instruction to proceed to a haven deemed to be safe for the prevailing conditions. During a recall the Charterer may be required to vacate the Boat depending on conditions. The Operator shall not be liable for any lost time, expense or losses to personal
goods of property due to recall and the Operator is not liable to repay any charter fees. The Charterer is advised to take out the appropriate insurance cover for such events.

Replacement
In the event that a fault in the Boat is detected before or during the charter period that may cause unsatisfactory performance of the Boat or equipment, then the Operator has the right to expeditiously effect repairs. In the event the Boat is in the Operator's opinion inoperable during part of the charter period through no fault of the Charterer rendering total or premature termination of the charter, the Operator may at its opinion endeavour to provide as a substitute an alternative boat of similar size and quality for the charter period. If no substitute boat can be provided the Charterer shall be entitled to reimbursement of charter fees for each full day of the charter which has not been used, less any cost incurred by the Operator under this clause.

Accident or Breakdown
In the event of any accident, loss, breakdown or disaster, the Charterer shall give immediate notice to the Operator and shall not except to the extent necessary to minimise a loss of the Boat, authorise or undertake repairs without prior authorisation of the Operator. The Charterer shall be responsible for the costs and consequence of any unauthorised repairs. The Charterer shall make no admission of liability to any party and no refund shall be made in respect of any claim arising out of such accident, loss, breakdown or disaster, save as is otherwise provided in this agreement. The Operator at its discretion shall determine if the cost of any repair, service (including cost for service vessels), breakdowns, recall or repossession or any other costs incurred by the Operator are chargeable to the Charterer and it so shall be owing by the Charterer.

Limitation of Liability
Nothing in this Agreement is to be read as excluding, restricting or modifying the application of any legislation which by law cannot be excluded, restricted or modified. To the extent permitted by law, the Boat, once chartered by the Charterer and delivered to the Charterer by the Operator or collected from the Port of Delivery by the Charterer shall be entirely at the risk of the Charterer. The liability of the Operator to the Charterer or any other person for any direct or indirect, special or consequential loss or damage to property (real or personal) or persons including personal injury or death, however caused or whether or not caused by or arising from any negligence or default, act or omission of the Operator in connection with the charter of the Boat, the performance of the services or the Operator's obligations under this Agreement or otherwise shall be limited to the supply of those services again or, at the Operator's discretion, a further charter of the Boat or another vessel.

Alcohol and Drugs
The use or consumption of illegal drugs by anyone using the Operator's facilities, property or boats, either ashore or afloat is prohibited. The consumption of alcohol may increase the risk of injury around docks, water and boats and the Charterer accepts that risk. The Operator shall not be liable for any personal injury or death arising from or in any way related to the use or consumption of alcohol or illegal drugs and the Charterer shall indemnify and hold the Operator harmless, in respect of any claims against the Operator arising out of such personal injury or death.

Personal Losses
The Operator shall not be liable for loss of personal property and goods of the Charterer whilst on the Operator's property or boats.

Insurance
The Boat chartered is customarily insured for the charter period as protection against any accidental loss or damage that may occur, or be caused by, the Boat during the charter period so long as the Boat remains in the cruising limits and perimeters established in clause 7 and is operated in compliance in all the terms and conditions of this agreement. In the case of a Bond being taken any excesses in connection with claims made under the policy may be debited by the Operator against the Charterer. In case of loss, accident breakdown, or a disaster, the Charterer shall give immediate notice to the Operator and shall not except to the extent necessary to avert or minimise damage or a loss of the Boat, attempt repairs without authorisation of the Operator.

Indemnity
The Charterer shall indemnify, reimburse and hold the Operator harmless from and against any acts and all claims, losses, liabilities, demands, suits, judgement or causes or actions and all legal proceedings whether civil or criminal and arising under contract, tort, statute or otherwise, penalties, fines and other sanctions and any other costs and expenses (including legal costs and expenses) in connection with or which may result from, or arise in any manner out of any matter (either directly or indirectly) related to this charter agreement or arise out of the management, control, encumbering use or operation of the Boat by the Charterer. No claim of any nature shall be brought against the Operator by the Charterer or any of the charter party or any third party and the Charterer agrees that he shall indemnify the Operator in respect of any amount paid by or claimed against the Operator in respect of any such claim.

Total Loss
Should the Boat become an actual or constructive total loss during the charter period, then the Operator may at its option substitute a vessel of similar type (if available) or deem this agreement to be at an end. In either circumstance there should be no refund of any part of the charter fee.

Inoperable Boat: In the event that in the reasonable opinion of the Operator the Boat becomes inoperable during the Charter Period through action or inaction of the Charterer or any of his party the Operator may at its option terminate his agreement and retain all charter fees paid. The Operator may then at its option offer a further charter to the Charterer on another vessel. The Charterer shall if he accepts the offer then pay a security bond and all costs of the further charter including the charter fee.

Water Sports
The Operator and its insurance underwriters shall not be liable for accidents, injuries or death due to: swimming: windsurfing; the use of the Boat's dingy and outboard engine; or the use of snorkels, masks fins or scuba equipment whether supplied by the Operator or otherwise, The user of the equipment referred to in this clause must ascertain that he is experienced, qualified and capable of using the equipment and the equipment is suitable and in good condition for the purpose for which it will be used and for the person using it.

Force Majeure
The Operator is not liable to the Charterer for any claim arising under this agreement in contract, tort, statute or otherwise, due to the performance of any obligation accepted by the Operator that is prevented, delayed or interfered for any reason beyond the Operator's control as a result of force majeure including without limitation by any act of war or terrorism, strikes or other industrial action, accident, breakdown, fire, cyclones, lightning, winds, storms or other acts of God, acts of governments or government authorities or any events of a similar nature beyond the reasonable control of the Operator.

Radio Arrangements
The Charterer agrees to Contact the Operator's base on or within such time as the Operator may at its discretion stipulate to the Charterer including each morning and afternoon on each day of the charter period and furnish necessary details of the Boat's position, intended plans for the day and intended anchorage position for that evening. In the event that the Charterer fails to so notify, and contact the Operators base on any two consecutive schedule periods, then that Charterer shall be responsible for all costs or expenses incurred by the Operator in searching for the Charterer including but not limited to, the hire of aircraft or other means of transport.

Government Fees and Future Taxes
Charterer's pay a fee of $25.00 per person which is payable on arrival in cash, for costs of the use of the Great Barrier Reef Marine Park. The Charterer shall also pay and discharge without exception all taxes, charges, assessments and outgoings and impositions relating to the charter imposed by or under federal or state law, by federal, state or local authorities and whether on a capital or revenue basis or any other basis and even though of a novel character which may at any time be introduced during the period from execution of this agreement to the end of the charter period.

Non-assignment
The Charterer shall not assign or sub-charter his interest in the Boat without the prior written consent of the Operator. The Operator may assign its rights under this agreement.

Applicable Law
This agreement shall be governed by the laws of the State of Queensland and the Commonwealth of Australia and any dispute arising or relating to the agreement or the charter shall be referred to the courts of Queensland and be heard at the nearest relevant court, being the Magistrates Court at Proserpine, the District Court at Bowen or the Supreme Court at Mackay.

Fuel
Fuel is not included and is charged on a user pays system on all charter vessels plus an additional flat rate of $30 for tender outboard fuel. The fuel costs are payable at the end of the charter. A form must be completed with up to date credit card details, upon arrival.

Children's Life Jackets
Under the Queensland Transport Law all vessels in Bareboat survey are required to have standard life jackets on board. The life jackets are one size only and cannot be substituted for any other size or style. We are able to provide charterers with children’s life jackets, which need to be ordered prior to your charter. It must be understood that these are not life saving devices and must only be used under strict adult supervision, we recommend that you provide your own children’s life jackets and buoyancy vests if possible.

Briefing Times
The charters commence the day of departure at 12:00 noon to the day of return at 12:00 noon. Prior to departure an area briefing followed by boat briefing takes place and will take approximately 3 hours depending on the type of vessel and your level of experience. All crew members are required to attend unless alternative arrangements have been made and confirmed.

An informative briefing DVD is sent to the charter who made the booking, ahead of time.

You are required to be at the office 15 minutes ahead of time, to complete any outstanding paperwork prior to commencement of your briefing session.

Any late arrivals may incur a cost or delay in your departure.

When flying into Proserpine/Whitsunday Coast Airport, we suggest you organize your flight to arrive no later than 11:30am. As your briefing can take approximately 3 hours, if you arrive at our office after 1:00pm you may be required to stay overnight in Shute Harbour.

Hamiltion Island Deliveries: If you have requested to board your vessel at Hamilton Island, we suggest you organize your flight to arrive no later than 12:00 Noon. As your briefing will take approximately 3 hours, you may be required to stay overnight in Hamilton Island Marina (a fee will apply) or return to one of our moorings at Shute Harbour (no extra cost) with the briefer on board.

Upon arrival at the airport please phone our toll free number 1800 075 000. This will enable us to give you the marina berth location or the contact number of your briefer who will be delivering your vessel.

For all Hamilton Island departures, all outstanding monies including bond must be paid at least 14 days prior to your commencement of charter. Up to date credit card details need to be provided for your fuel usage to be charged.

Mid Charter Turnaround
If you are chartering for 9 nights or more, you will need to return to Shute Harbour approximately half way, (i.e. day 6) through your charter for a mid-charter turnaround. During your turnaround you will be supplied with fresh linen, refueled, water tanks refilled and if you have ordered provisions, your vessel will be re-provisioned. If you order self select provisioning, two orders will have been made, the second one being your re-provisioning.

Handy Hints

  • Linen - We supply all linen with two bath towels per person, hand towels, tea towels. So don’t forget to pack your own beach towels.
  • Sunscreen - For your protection from the sun, especially whilst on the water, pack 30+ and zinc cream.
  • Kids Life Jackets - For the comfort and safety of your child we will need to know your child’s height and weight so we can supply you with the correct life jacket. Please let us know prior to your arrival.
  • Insect Repellent - Don’t forget insect repellent. If you are travelling from overseas, leave buying this until you get here as Australian brands seem to work better on our local insects.
  • Sun Glasses - Polarized sun glasses are ideal for spotting reefs when anchoring. These are available for sale at our jetty shop if you forget to bring your own.
  • Hats - A shady hat is a must. If you forget yours, we have caps for sale at our jetty shop.
  • Sport Shoes - Sneakers or old shoes that can get wet are ideal. When going ashore to coral beaches, be careful of sharp rocks and coral. Reef walkers can be purchased at our jetty shop.
  • Fishing Gear - Fishing gear is not supplied. Due to the eco sensitivity of the area we do not encourage spear gun fishing. If you do wish to do some fishing please refer to a zoning map for fishing locations.
  • Games - There are no games onboard so bring some cards or aboard game. It is always great to play cards or a board game while the sun goes down – beats TV any day.
  • Books - You get plenty of time for reading so bring a book or two. The cockpit is an ideal place to lie down, relax and read.
  • Fins - We provide fins free of charge. If departing from an island marina please advise us of your shoe size so we can put the correct size fins on board for you. Note – we do not supply children’s sizes.
  • Top Up Shop - Available at our Jetty Shop – Ice, polo shirts, T-shirts, singlet’s, caps, souvenirs, sunscreen, basic toiletries and sunglasses.
  • Stinger Suits - These will not only protect you from the sun whilst swimming and snorkeling, but act as a barrier against coral cuts, sea lice and jellyfish (Irukandji & Box). We highly recommend wearing stinger suits all year round.
  • Snorkel Gear - Masks and snorkels are not supplied on board. We hire out snorkel gear for a small fee of $5 per set of sanitizing.

The stinger suits and snorkel gear are hired out from an outside source, so please let our friendly staff know prior to departure if you want to hire any gear and we will organize it for you.

Damage Levy Fee: Non refundable Damage Levy Fee provides the charterer with a No Blame Policy that protects the charterer against any cost incurred to rectify damage to the vessel and its fittings or loss of inventory from the vessel, providing at all times the charter vessel is operated in a safe and responsible manner in accordance with the charter agreement. The fee is calculated at a rate according to vessel size by the number of nights of the charter.

Bond Option: Non refundable Damage Levy Fee $100 plus refundable $2500 Bond option is available.

Travel/Holiday Iinsurance

Before you set off on any boating holiday it is vital you have the appropriate travel insurance. Everyone wants their charter boat holiday to go as planned, but sometimes "what if's" do happen. Cancellation fees, loss, damage or theft of your personal baggage, additional travel costs to return home earlier or later than planned can all have a huge impact on your budget. Travel insurance is an essential part of your travel budget. You can purchase your own policy or to find out more information.

Travel and Cancellation Insurance: The Operator strongly recommends that you take out adequate insurance for boat rental on your sailboat charter to cover yourselves in case you are forced to cancel due to unforseen circumstances, curtailments or interruptions beyond your control. A visitors plan is available for overseas clients.

Bareboat Hirers Liability Insurance: This policy is designed to protect you from claims made against you by others for Property Loss, Accidental Death, Bodily Injury or Illness to them caused by (or as a result of) your negligence. For this policy to apply to you, the hired vessel or the tender must be involved in the loss.
